Welcome to Givo (“Givo,” “we,” “us,” or “our”). Givo is a smart fundraising platform that connects donors, NGOs, and changemakers, making giving easy, transparent, and impactful. These Terms of Use (“Terms”) govern your use of our website, platform, and services (“Services”).

By accessing or using Givo, you agree to these Terms. If you do not agree, please do not use our Services.

1. Eligibility

Use of Givo is available only to persons who can form a legally binding contract under the Indian Contract Act, 1872. If you are a minor (under 18 years of age), you may use our Services only with the involvement of a parent or legal guardian.

2. Services Offered

Givo provides the following services (“Services”):

Secure payment processing through authorized payment gateways.

Donor communication tools (email, WhatsApp, SMS).
Automated generation of receipts compliant with Section 80G, 12A, and 10BD of the Income Tax Act.
Analytics dashboards and donor insights.

Givo acts only as a technology intermediary and is not the recipient of donations. Donations are made directly to the NGO selected by you.

3. User Account

To access certain features, you must create an account. You agree to:

Provide accurate and complete registration information.
Maintain the confidentiality of your login credentials.
Notify us immediately of any unauthorized use of your account.
You are solely responsible for all activities that occur under your account.

4. User Obligations

You agree to use Givo’s Services only for lawful purposes. You shall not:

Engage in fraudulent, harmful, or unlawful activity.
Upload false, misleading, or offensive content.
Attempt to gain unauthorized access to our systems.
Interfere with or disrupt the Website, servers, or networks.

5. Donation Processing

Payments are processed by third-party payment gateways integrated with Givo.
Upon successful payment, you will receive an electronic receipt from the NGO, issued instantly.
You are responsible for providing accurate details (email, PAN) to receive valid receipts.
Givo is not responsible for delays caused by banks, payment gateways, or network failures.

6. Fees and Charges

Givo may charge a commission or service fee on donations or transactions,based on the type of transaction and agreements with NGOs or donors.
All applicable fees, commissions, or charges will be clearly displayed to users
before completing any transaction, ensuring full transparency.

7. Intellectual Property

All content, software, logos, text, graphics, and trademarks on the Website are owned by Givo or its licensors. You may not copy, reproduce, modify, distribute, or create derivative works without prior written consent.

8. Data Privacy

We collect, process, and share personal data in accordance with our [Privacy Policy]. By using Givo, you consent to the collection and use of your data as described therein.

Givo provides the Services on an “as is” and “as available” basis. We do not warrant that the Services will be uninterrupted, timely, or error-free. To the fullest extent permitted by law:

Givo shall not be liable for indirect, incidental, or consequential damages arising out of the use of our Services.
Givo’s liability, if any, shall not exceed the amount of fees paid (for NGOs) or the donation amount (for donors) in dispute.

10. Indemnification

You agree to indemnify and hold harmless Givo, its officers, directors, employees, and partners from any claims, losses, damages, liabilities, including legal fees, arising out of your use of the Services or violation of these Terms.

11. Termination

We may suspend or terminate your access to the Services without prior notice if:

You violate these Terms,
Engage in fraudulent activity,
Misuse the platform or disrupt services.

Upon termination, your right to use the Services will immediately cease.

12. Changes to Terms

We may modify these Terms of Use at any time. Changes will be posted on this page, and continued use of the Services after such changes constitutes your acceptance of the updated Terms.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed under the laws of India. The courts of Bengaluru, Karnataka shall have exclusive jurisdiction over any disputes.
